New classification for purposes of economic activity

Since 1.1.2008 a new statistical classification of economic activity is in force in Poland. In part, this differs substantially from the old one. The old classification remains in force to 31.12.2009.

The business object of a newly formed company is to be determined on filing application for entry in the Register of Companies in accordance with the new classification. The same applies to existing companies, whose business object is to be changed.
So far, it is unclear whether existing business objects of existing companies, which are not in fact to be changed up to 31.12.2009, must be adapted to the new classification. This would in any case involve a certain expenditure of time and costs.
An express obligation to change of the company object cannot actually be inferred to the new classification. However on the part of the statistical authorities the view is represented that such an adjustment is necessary. It appears in any case advisable to implement such a change when amending the articles of association.
